1. Agreement to Terms

By accessing or using LimitlessAI services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you disagree with any part of these terms, you may not use our services.

2. Definitions

The following definitions apply to these Terms and all content on the LimitlessAI website:

• "LimitlessAI," "we," "us," or "our" refers to LimitlessAI Inc., a cloud infrastructure services provider.
• "Services" refers to the cloud computing services, including virtual servers, storage, networking, and related offerings, that LimitlessAI provisions, manages, and makes available to customers.
• "Platform" refers to the LimitlessAI software, APIs, control panels, and user interfaces through which customers access and manage Services.
• "Infrastructure," "Global Network," or "Network" refers to the computing resources, servers, storage systems, and networking equipment through which Services are delivered. This infrastructure is physically owned and operated by third-party Infrastructure Partners and made available through LimitlessAI.
• "Regions" refers to geographic service areas where Services are available. Each region corresponds to one or more physical facilities operated by Infrastructure Partners.
• "Infrastructure Partners" refers to the third-party data center operators, colocation providers, and infrastructure providers whose physical facilities and equipment are used to deliver LimitlessAI Services.
• "Credits" or "Service Credits" refers to non-refundable monetary value applied to a customer's account that may only be used to purchase LimitlessAI Services and cannot be exchanged for cash.
• "Customer," "you," or "your" refers to any individual or entity that creates an account or uses LimitlessAI Services.

3. Nature of Services

3.1 Infrastructure Provider

LimitlessAI operates as a cloud infrastructure services provider, offering access to computing resources, storage, and networking capabilities through partnerships with third-party data center operators and infrastructure providers. LimitlessAI does not own or operate the underlying physical data center facilities.

3.2 Service Delivery

Our services are delivered through a network of partner infrastructure providers across multiple geographic regions. While we manage and provision the services you access, the physical infrastructure is owned and maintained by our infrastructure partners who meet our security and reliability standards.

3.3 Responsibility

LimitlessAI is responsible for:

• Service provisioning, management, and customer support
• Billing, account management, and customer relationships
• Platform software, APIs, and user interfaces
• Ensuring partner infrastructure meets our service standards

Our infrastructure partners are responsible for:

• Physical data center operations and security
• Hardware maintenance and replacement
• Network connectivity and power infrastructure
• Physical compliance certifications for their facilities

4. Use of Services

4.1 Account Registration

To use our services, you must create an account providing accurate and complete information. You are responsible for maintaining the security of your account credentials.

4.2 Acceptable Use

You agree not to use our services to:

• Violate any laws or regulations
• Infringe intellectual property rights
• Distribute malware or harmful code
• Engage in cryptocurrency mining without authorization
• Launch attacks on other systems or networks
• Send spam or unsolicited communications

5. Payment Terms

5.1 Billing

Services are billed monthly or hourly based on your plan. Payment is due upon receipt of invoice.

5.2 Billing Descriptor

Charges from LimitlessAI will appear on your credit card or bank statement as "LIMITLESSAI" or "LIMITLESSAI.CLOUD". If you do not recognize a charge, please contact us at admin@limitlessai.pro before disputing with your bank.

5.3 Pricing Changes

We reserve the right to modify pricing with 30 days notice for existing customers.

5.4 Refunds

We offer a 30-day money-back guarantee for new customers on their initial service purchase. To request a refund, contact admin@limitlessai.pro within 30 days of your first payment. Refunds are not available for:

• Violations of these Terms of Service
• Promotional credits or bonuses (see Section 5.5)
• Services used beyond minimal testing
• Accounts with chargebacks or payment disputes

5.5 Promotional Credits

Promotional credits or bonuses are issued as non-refundable service credits. Credits may only be used for LimitlessAI services and cannot be exchanged for cash or transferred. LimitlessAI reserves the right to modify or discontinue promotional offers at any time. All promotional offers are subject to eligibility verification.

5.6 Cancellation

You may cancel your account at any time by contacting admin@limitlessai.pro. Upon cancellation:

• Active services will remain available until the end of your current billing period
• No refunds will be issued for partial billing periods
• Any remaining service credits will be forfeited
• Your data will be retained for 30 days, after which it will be permanently deleted

6. Service Level Agreement

Service level commitments are provided in accordance with our published SLA. Uptime guarantees are measured at the service layer managed by LimitlessAI and are subject to the terms outlined in our SLA page. Infrastructure-level incidents at partner facilities may be subject to separate terms.

7. Intellectual Property

You retain all rights to your data. We claim no ownership over content you store on our infrastructure. You grant us limited license to provide the services.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LIMITLESSAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM USE OF OUR SERVICES. This limitation includes, but is not limited to, any failures, interruptions, or issues arising from our infrastructure partners' operations.

9. Indemnification

You agree to indemnify and hold harmless LimitlessAI from any claims arising from your use of our services or violation of these terms.

10. Termination

Either party may terminate this agreement with 30 days notice. We may suspend or terminate services immediately for violations of these terms.

11. Governing Law

These terms are governed by the laws of Delaware, United States, without regard to conflict of law provisions.
